March 12, 2024

A resident of Akmesdzhit (Simferopol) was detained for 8 days for “Oh, the Red Viburnum in the Meadow ” in the playlist called “Liked” on the YouTube channel. This is reported by the Telegram channel “Tribunal. Crimean episode”.

“The court” determined that “all tracks (“Oh, the Red Viburnum in the Meadow ” – ed.) belong to the unofficial anthem of the UPA” and found her guilty under Article 20.3 of the Administrative Code (“demonstration of Nazi symbols”). “The court” decided to arrest the woman on the basis of the protocol of the “Center for Counteracting Extremism” and the certificate of the operative worker of the Center “E”.

“Such a conveyor belt approach to the issue of musical works is inadmissible, because, for example, the same song “Oh, the Red Viburnum in the Meadow ” was regularly performed by Russian singer Alexander Malinin at his concerts, and in the cult Soviet movie “Only Old Men Go to Battle” the words from this song are sung by actor Leonid Bykov. These materials have not yet been recognized as extremist, are not banned for publication and are freely available on YouTube and in a large number of social networks,” reads the message from the telegram channel.

Recall that on January 19, 2024, the Ministry of justice of rf introduced the Organization of Ukrainian nationalists, its units and slogans in the list of “Nazi” organizations. In addition to adding the slogans “Glory to Ukraine” and “Glory to the Heroes” to the list, they also added a stylized golden trident, the middle element of which is made in the form of a double-edged sword, as well as the flag of the OUN with red and black horizontal stripes. The demonstration of symbols of organizations and the use of their slogans is punishable by administrative liability under Article 20.3 of the Code of Administrative Offences of the Russian Federation (“Propaganda or public demonstration of Nazi attributes or symbols”), i.e. a fine of up to 2 thousand rubles or arrest for 15 days. For officials, the fine is up to 4 thousand rubles, for legal entities – up to 50 thousand rubles.
