The State Migration Service of Ukraine and the Ministry of Justice will consider the issue of simplifying the procedure for submitting documents for obtaining the first passport for citizens of Ukraine from the TOT.
Despite nine years of occupation of part of Ukrainian territories and almost a year of full-scale Russian aggression against Ukraine, the current legislation of Ukraine still contains certain provisions that make it much more difficult for Ukrainian citizens to obtain Ukrainian passports for the first time, who were still minors at the time the occupation began in 2014. Also significant problems are experienced by those young people whose parents do not support their desire to obtain a passport of a citizen of Ukraine.
When providing legal assistance, the lawyers of the Crimean Tatar Resource Center constantly face a problem: in order to apply for the first passport of Ukraine, a young person from the temporarily occupied territory must submit to the SMC authorities a paper copy issued in Ukrainian, a birth certificate or an extract from the relevant registry office about birth. At the same time, in order to receive birth documents (certificate or extract) from the registry office, this young man must provide an identity document, that is, a passport of a citizen of Ukraine. We get a vicious circle, the way out of which is possible after making changes to the current legislation of Ukraine.
At the initiative of the lawyer of the CTRC, lawyer Volodymyr Liashenko, this problematic issue was included in the agenda of the meeting of the Coordinating Headquarters on ensuring the departure of Ukrainian citizens from the territory of Ukraine temporarily occupied by the Russian Federation, in particular, the Autonomous Republic of Crimea and the city of Sevastopol, through the territory of other countries to the territory Ukraine, assistance in returning to Ukraine, created in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 1187 dated 10/18/2022.
Based on the results of the discussion chaired by Deputy Prime Minister Iryna Vereshchuk at a meeting of the Coordination Headquarters on February 16, 2023, a corresponding instruction was prepared by the State Customs Service and the Ministry of Justice, together with representatives of the public sector, to continue working on the issue of submitting documents for obtaining the first passport of a citizen of Ukraine in the absence of a birth certificate issued on Ukrainian.
We hope that in the near future the problematic issue will be resolved and the vicious circle is broken!
