The Investigative Committee in occupied Crimea refused to allow Nikolai Polozov to participate in the so-called case of the Head of the Mejlis of the Crimean Tatar people Refat Chubarov as a lawyer, since he had previously defended Akhtem Chiygoz in the so-called February 26 case, of which the investigator considers Chubarov to be an accomplice. This was reported by Polozov via his Facebook page.
“As a basis, the investigator indicated that I previously defended Akhtem Chiygoz in the so-called February 26 case, within which the investigator considers Refat Chubarov to be an accomplice. Akhtem Chiygoz has already given evidence to the court on the merits of the charge. Therefore, according to the investigation, between the interests of one of my clients and another one may be contradictory, which excludes the possibility of my participation in the case”,- the message said.
The lawyer explained that the only significant circumstance that does not allow the lawyer to defend simultaneously two individuals involved in the same case is the existence of significant contradictions in their interests (positions).
“So everything goes smoothly with the Investigative Committee, if it weren’t for one essentiall thing. Refat Chubarov was not involved in the so-called February 26 case in any of the procedural statuses. He was not involved in the case as a suspect or accused, he did not give testimony as a witness neither during the preliminary investigation, nor at the trial itself”,- he added.
We remind that in the occupied Crimea, the so-called Russian Investigative Committee instituted a criminal case against the Head of the Mejlis of the Crimean Tatar people Refat Chubarov, who was suspected of allegedly organizing riots in 2014.
