The administration of the Crimean Engineering and Pedagogical University (CIPU) presented two mutually exclusive pieces of evidence in the case of Emil Kurbedinov. This was told to “Crimean Solidarity” by the lawyer Lilia Hemedzhi and Emil Kurbedinov himself.
In the first response to the request of the Magistrate “court” of Akmesdzhit (Simferopol) it is stated that after the publication of the post in the telegram channel “KEMskaya volost” to receive subpoenas to the military enlistment office, which conscripts have the right to hand to universities, did not arrive 34 students, which “significantly exceeded the number of those who did not arrive in the previous drafts and the draft of spring 2024”. Lawyer Lilia Hemedzhii noted that students have no obligation to “self-subpoena.”
This letter was followed by another response from the university signed by rector Chingiz Yakubov: the letter, as Gemedzhi emphasised, contains completely different data. It says that in 2023, about 30 percent of students to whom the university should have given subpoenas refused to receive them and go to the military enlistment office. According to the version of the HEI, allegedly because of a report in the channel “Kema volost” that military enlistment centres draft students even with deferment.
“Subsequently, the students who did not appear at the military enlistment office on summons were brought to the responsibility established by law. The dissemination of this information had a negative impact on the educational process of the university, in particular in terms of military registration, as well as on the recruitment campaign,” – Yakubov wrote.
Lilia Hemedzhi noted that the university did not provide any evidence of this “negative influence”.
“Taking into account the number of students and the figures voiced by the Ministry of Defence for the draft campaign, this amounts to 0.002% of all conscripts. Such refusal of summonses could not have influenced the draft campaign in any way,” Lilia Hemedzhi added.
The court also appointed a linguistic examination of the post, but the defence side was confused by the choice of the expert organisation that would conduct the study and its specialists.
“We asked to perform the study in independent organisations that are not located on the territory of Crimea, but the court rejected this proposal. We were, to put it mildly, critical of the conclusions and their qualifications are not appropriate. We will challenge the expert and file other motions”, – Emil Kurbedinov emphasised.
