The Investigative Committee of the Russian Federation refused to initiate a criminal case against the employees of the pre-trial detention center in Rostov-on-Don and the medical unit regarding the circumstances due to which Dzhemil Gafarov died. Lawyer Rifat Yakhin told Crimean Solidarity about this.
“From a legal point of view, the decision is, of course, illegal. Because the check is not objective and was carried out unilaterally, only employees of the state service were interviewed – the head of the pre-trial detention center, a paramedic, who stated only what happened. Although even they pointed out that Gafarov constantly complained about his state of health. Nobody denies this fact”,- said Rifat Yakhin.
According to him, the investigators did not talk to the cellmates from pre-trial detention center 3 of Novocherkassk, who could observe how the person they are sitting with actually dies before our eyes and did not talk to the guards who transferred Gafarov from detention center 5 of Rostov-on -Don to Novocherkassk. Yakhin said that he does not yet know whether he will appeal against this refusal in court or the prosecutor’s office.
The response of the Investigation Committee says that the paramedic of the medical unit 61 by the name of Kudim repeatedly heard Gafarov ask for help, and he fulfilled these requests.
“He repeatedly underwent treatment, and was also under dynamic observation in the medical unit. The necessary list of documents was also collected for recognizing Gafarov, who was arrested under investigation, as a disabled person of the second group indefinitely”,- Kudim is quoted as saying.
The paramedic emphasized that it was not his responsibility to transport patients to other clinics. The head of the branch of medical unit 14, which is under the jurisdiction of medical unit 61 and to which the Crimean Tatar was attached, replied that he was taken to the hospital on February 8, 2023, examined, and Gafarov did not express any complaints. The political prisoner was quarantined, there were no complaints again, but on February 10 he became ill and called a doctor.
Gafarov was found half-sitting on the bed: he was wheezing, his pulse was weak, his blood pressure was 60/30. They began to resuscitate him, but it did not bring a positive result, and after half an hour the doctors pronounced him dead. Gulyakina is sure that no illegal actions were committed against Gafarov, and medical assistance was provided in full and in a timely manner.
The head of pre-trial detention center 5 of Rostov-on-Don, Pavel Lazarenko, said that when Gafarov was in the Rostov detention center, he repeatedly complained about his health and repeatedly underwent treatment and was under observation in the medical unit 61.
According to him, on January 25, 2023, he received documents from Semedliaiev’s lawyer stating that Gafarov should be transferred to a paid clinic. The statement noted that Gafarov was getting worse, he was experiencing severe pain and burning in the region of the heart, a headache, he had difficulty breathing and high blood pressure. The head of pre-trial detention center 5 claims that the draft response to Edem Semedliaiev was signed by Lazarenko on February 2, and on the 8th Gafarov was transferred to pre-trial detention center 3 of Novocherkassk. At the time of transfer, said the head of pre-trial detention center 5, Gafarov did not express any health complaints.
The investigation concluded that the actions of the interviewed specialists did not contain signs of a crime, and their actions did not lead to a significant violation of the rights and legitimate interests of citizens.
