Crimean political prisoner Server Mustafayev was not satisfied with his petition for the return of personal belongings that were taken from him during the transfer. Maya Mustafaeva reported this to the Crimean Tatar Resource Center.
“He has already had three trials of administrative claims in different pre-trial detention centers: three have already been completed and one more is in progress. According to two petitions, the claims were satisfied, the first trial was in a pre-trial detention center from Simferopol: there was a search, the Koran and his personal papers were taken away. After the petition was granted, all this was returned to us, the family. The second trial took place while he (Server Mustafayev – ed.) was in Novocherkassk, filing claims for inadequate medical care because he was refused, and while the response was coming, medical care, frankly speaking, was no longer needed by anyone. The third claim that he submitted to the pre-trial detention center was not granted, because they believed that everything was done correctly. The last trial was in Ryazan, when he was in transit and his personal belongings were taken away, and we couldn’t even make a single transfer in the store, because those who are in transit cannot receive anything – there they could do whatever they could. got out. There they took the medicines and everything else…”,- Maye reports.
It is known that the political prisoner will file a petition with the cassation courts regarding this incident.
“The petition was not granted, everything, as it turns out, is normal. Server is trying to achieve justice and will continue to serve”,- she explains.
In addition, she recalled the harsh conditions in which Mustafayev was kept.
“For six months now he has been in harsh conditions of detention: these are conditions under which he cannot go for a walk outside, since it is a closed space, so they do not see either the sun or fresh air. … Now he is allowed visits and parcels only once every six months, whereas when he was in the general detachment, he could be visited every four months. Also it does not work because it is prohibited in this detention chamber. These are his conditions of detention now”,- she adds.
We remind you that on October 11, 2017, in the city of Bakhchisaray, the occupants carried out mass searches in 6 dwellings of Crimean Tatars – Marlen Asanov, Seyran Saliiev, Timur Ibrahimov, Memet Belyalov, Ernes Ametov, Server Zakiryaev. Everyone was detained. They were charged under Article 205.5 of the Criminal Code of the Russian Federation “Participation in the activities of an organization which, in accordance with the legislation of the Russian Federation, is recognized as terrorist”.
On May 21, 2018, Russian security forces raided the dwellings of activists of the Crimean Solidarity public association in the occupied Crimea, as a result of which Server Mustafayev and Edem Smailov were detained. They were also accused of their membership in Hizb ut-Tahrir organisation, which is prohibited on the territory of the Russian Federation.
In February 2019, a criminal case was opened against eight individuals involved in the so-called second Bakhchisaray Hizb ut-Tahrir case – Marlen Asanov, Seyran Saliiev, Timur Ibrahimov, Memet Belyalov, Ernest Ametov, Server Zakiryaev, Server Mustafayev and Edem Smailov (Violent seizure of power or violent retention of power).
On March 5, it became known that the two defendants in the so-called second Bakhchysarai Hizb ut-Tahrir case – Timur Ibrahimov and Memet Belyalov – had their charge tightened from part two of Article 205.5 of the Criminal Code (participation in the activities of a terrorist organization) to the part one (organization of the activities of a terrorist organization).
On September 16, the Southern District Military Court in Rostov-on-Don announced the verdict to the defendants in the second Bakhchysarai Hizb ut-Tahrir case. Marlen Asanov was sentenced to 19 years in a strict regime colony, Memet Belyalov – to 18, Timur Ibrahimov – to 17, Seyran Saliiev – to 16, Server Mustafayev – to 14, Server Zakiryaev and Edem Smailov – to 13. Ernest Ametov was found innocent and released in the courtroom.
