The political prisoner suffered material damage due to the fact that he failed to issue a power of attorney for his relatives, since the head of the pre-trial detention center refused to sign the order. Mustafayev was forced to invite a notary to receive a notarized power of attorney, which includes: the cost of train tickets, to and from the place, a taxi in the direction of Michurinsk-Tambov and back, the cost of the power of attorney and the departure of the notary, as well as preliminary consultation with a lawyer. The total amount of these expenses is 37,641.9 rubles, the cost of a trip to Novocherkassk with the preparation of the text of a power of attorney is 10,128 rubles.
All complaints and lawsuits from him were also not transferred.
“The defense side specified the stated claims for the recovery of material damage suffered by Server Mustafayev, taking into account the illegal actions of the pre-trial detention center”,- Mustafayev’s lawyer, Lilia Hemedzhi, specified.
During the court session, the political prisoner spoke clearly about the grounds indicated in the claim document. Prisoners of the second Bakhchysarai group were involved as witnesses: Server Zakiryaev confirmed Mustafaev’s evidence about the illegal actions of the pre-trial detention center, for example, that violations of political prisoners were recorded by the administration without notification or warning. It was also not possible to obtain a power of attorney to represent the interests of relatives.
The second witness, Seyran Saliiev, was unable to speak because he could not be turned off for technical reasons.
