Lawyer Rifat Yakhin sent a statement to the Investigative Committee in order to bring to justice the employees of the Federal Penitentiary Service in the case of the death of Jemil Gafarov. It is reported by the Crimean solidarity.
The employees of the medical unit 3 are specifically mentioned.
“Everyone should be held accountable for their crimes according to the law. If Gafarov was convicted for allegedly committing a crime, then those responsible for his death must be held accountable. Everyone is equal before the law. The man, roughly speaking, was deliberately sent to his death, being transferred to detention center 3 of Novocherkassk. Perhaps, in a different situation, he would have survived”,- the lawyer said.
Yakhin made several accusations: failure to provide medical care to the patient, abuse of power and negligence.
According to the lawyer, Gafarov several times during the month complained to the administration of the pre-trial detention center about migraines, high blood pressure, heart and breathing problems.
“And I again talked about my sores with the doctor. He said that they had passed the tests, they would look. The process can be delayed, because there are few doctors, and, as usual, there are many patients. And now for the fourth day there is no answer, no greeting. I am writing statements to the head of pre-trial detention center 5, the medical unit, and the security services. Orally – I voice it during the rounds of the doctors, but everyone agreed – no one knows anything. My health is not improving. I’m waiting for your help”,- Gafarov complained.
Now the defense is waiting for the reaction of the investigators.
“We will wait for an answer. There is always hope, of course, but it is not strong, because in this case all these bodies – the Federal Penitentiary Service, the prosecutor’s office, the investigation, the court – cover each other. All in one harness. If they answer us that the appeal does not contain signs of a crime, most likely we will sue”,- said Yakhin.

On February 10, 2023, Dzhemil Gafarov, a political prisoner, passed away in pre-trial detention center 3 in Novocherkassk, Rostov Region, due to the failure to provide proper medical care.
