– Do not panic, control yourself (panic hurts), do not actively resist, do not agree to any offers;
– Immediately clearly and insistently demand the presence of your lawyer during the search (have the phone numbers of several lawyers in advance);
– Persistently ask everyone who arrived, before they enter your house, to present an official ID; write down on the sheet all the data from the certificate (name, position, rank, number and date of the certificate);
– Demand to immediately show a copy of the court decision on the search (make a photocopy if possible);
– Immediately demand video recording of the search; make video (photo) recording using available technical means (preferably not your own, but other family members) – there is no provision in the law prohibiting a searched person or members of her/his family from taking photos and videos during a search; if possible, immediately broadcast the search live to the Internet or to cloud storage;
– Immediately clearly indicate that you do not trust witnesses who arrived with the police, the FSB, because they are interested persons who arrived together with law enforcement officers, and demand that witnesses whom you know (neighbours, etc.) be invited;
– Keep your search protocol yourself or entrust it to one of the adult family members. Write down all the information – the time when law enforcement officers entered the house; who went where and where; in what order is the search carried out; time, when, where and what was “found”. This will force “law enforcement” officers to keep themselves within the bounds of the law;
– Categorically object to one of the law enforcement officers without witnesses entering any room. If this happened, immediately record it in your protocol and demand that it be included in the search protocol;
– STRONGLY do not touch any things that law enforcement officers are trying to put into your hands, and especially those that were “planted” (found) during the search;
– Carefully watch the hands of those who conduct a search in your house, and especially when they check your things in the cabinets;
— At the end of the search, demand to hand you a copy of the search protocol and a description of the seized property (the removal of objects and documents can be appealed in court and the prosecutor’s office); If there are no things in the description of the property, immediately voice it and demand that they be added to the description;
– When you are given a search protocol for signing, never sign right away, be sure to FIRST write – “The search was conducted in violation of the law, I will appeal”, and only then sign.
— During the search, it is FORBIDDEN to damage property unnecessarily and to disclose the circumstances of your private life.
