Prosecutor Asked Nearly One Hundred Years of Imprisonment for Six Defendants of Hizb ut-Tahrir Case – Lawyer

On Friday, October 11, in the Southern District Military Court of Rostov-on-Don in Russia, during the dispute, the prosecutor requested 13 to 20 years in prison for the defendants of Yalta “Hizb ut-Tahrir case”: Emir-Huseyn Kuku, Vadim Siruk, Muslim Aliev, Enver Bekirov, Arsen Dzhepparov, and Refat Alimov. This was reported by lawyer Edem Semedlyaev on his Facebook page.

According to the lawyer, the prosecutor during the dispute asked the court to charge the Yalta defendants guilty and provide for punishment:

  • Muslim Aliev – part 1, article 205.5 -17 years of imprisonment; part 1, article 30, article 278 – 9.6 years of imprisonment; in total 20 years of imprisonment.
  • Enver Bekirov – part 1, article 205.5 -17,6 years of imprisonment; part 1, article 30, article 278 – 9.6 years of imprisonment; in total 20,6 years of imprisonment.
  • Emir-Huseyn Kuku – part 2, article 205.5 – 8 years of imprisonment; part 1, article 30, article 278 – 9 years of imprisonment; in total 15 years of imprisonment.
  • Vadim Siruk – part 2, article 205.5 – 8 years of imprisonment, part 1, article 30, article 278 – 9 years of imprisonment; in total 15 years of imprisonment.
  • Arsen Dzhepparov – part 2 of article 205.5 – 7 years of imprisonment; part 1, article 30, article 278 – 8 years of imprisonment; in total 13.6 years of imprisonment.
  • Refat Alimov – part 2, article 205.5 – 7.6 years of imprisonment; part 1, article 30, article 278 – 8.6 years of imprisonment; in total 14.6 years of imprisonment.

The aforementioned political prisoners are accused of participating in the organization Hizb ut-Tahrir, which is banned in the Russian Federation. They are charged with article 205.5 of the Criminal Code of the Russian Federation (“organization of the activities of a terrorist organization and participation in it”). Later they were charged with article 278 of the Criminal Code ("Forced seizure of power or forcible retention of power").

On November 22, 2018, the North Caucasian District Military Court in Rostov-on-Don returned Yalta "Hizb ut-Tahrir case" for re-examination to the "prosecutor" in Crimea.        

In December 2018, six defendants of the Yalta "Hizb ut-Tahrir case" were transferred from Russia to the annexed Crimea after the case was returned for further investigation and change of charges.
