Statement of the human rights organization “The Crimean Tatar Resource Center” on violation of the rights of the Crimean Tatar people representative Khalilov Nedim Abdulaevich, imprisoned in the Center for temporary detention of foreign nationals of the Krasnodar Territory, Russian Federation.
Khalilov N.A., Crimean Tatar by nationality, a person, born in exile, from the birth limited in civil rights in conditions of the deportation of the Crimean Tatar people.
Upon returning to the historical homeland of the Crimean Tatar people – in Crimea, taking an active social position after the collapse of the USSR, Khalilov N. A. since 1991 refused to receive the citizenship of Ukraine in protest against the violation of rights of the Crimean Tatar people and the refusal of the authorities of Ukraine to restore the Crimean Tatar national autonomy in Crimea.
In fact, before the occupation and annexation of Crimea by the Russian Federation in 2014, Khalilov N.A. used the passport of a citizen of the USSR, which allowed him to have a business and run a household while living in Crimea, in his house, with his family. Since March 2014 under the jurisdiction of the Russian occupation authorities, such status of the person de facto in Crimea became impossible.
Khalilov N.A., taking into account the refusal of Russia to provide the rights of the Crimean Tatar people in Crimea, refused to receive the documents of the citizen of the Russian Federation, and demanded that the occupation authorities to issue him a document on the status of a stateless person and residence permit in Russia-controlled Crimea.
In this application Khalilov N.A. was refused. Despite the fact that the person, even in the face of his civil position, had the right at least to citizenship of Ukraine, because of his active social position and nationality became an undesirable person for the occupation authorities.
Therefore, on November 7th, 2016, the so-called occupation "Zheleznodorozhniy District Court of Simferopol" decided to subject him to an administrative expulsion from the historical homeland, "outside the Russian Federation" as a "foreign citizen". This “court” decided without any evidence that Khalilov N.A. was a citizen of Uzbekistan, at the same time did not point the country of expulsion in its decision. On the same day, Khalilov N.A. was taken out from Crimea and was held in the Center for temporary detention of foreign nationals at the following address: str. Lvovskaya, 2, Vardane, Sochi, Lazarev district, CTDFN, Krasnodar territory, Russia 354209, until December 29,2016.
On November 21, 2016, Khalilov N.A., realizing that he may be held in CTDFN for years, since Russian authorities have no other country to expel him to, and realizing that their real purpose – to deport him from Crimea again- the authorities of the Russian Federation have already achieved, not excluding possible provocations, went on a hunger strike.
On December 8, 2016, CTDFN administration conducted a medical examination on the subject of the reality of his hunger strike. After receiving positive confirmation, banned medical workers to carry out health surveillance on Khalilov N.A., his means of communications were taken, blocked the flow of water in the building, where he’s contained.
Repeated statements and appeals from Khalilov N.A. to judicial, administrative and law enforcement bodies of the Russian Federation did not change the situation.
On December 29, 2016 at 06:30 a.m. Khalilov N.A. together with other prisoners will be transferred to another camp – in Gulkevichi. He was given one hour to pack his belongings. Khalilovis on a hunger strike for 38 days. He was refused in hospitalization and medical supervision. He may not stand the way of 600 kilometers, among 150 people and even if he survives, his health would be irreversibly injured.
This situation testifies about violationsby the Russian authorities against Khalilov NA of the rules of the IV Geneva Convention of 1949 about the Protection of Civilian Persons in Time of War, the rules of Articles 2, 4, 5, 6, Convention on the Elimination of All Forms of Racial Discrimination of 1965, the provisions of Articles 1, 2, 6, 7, 9, 10, 12, 13, 16, 17, 18, 19, 26, 27 of the International Covenant on Civil and Political Rights of 1966, Art. 2, 3, 5, 6, 17 of the Convention on the Protection of Rights and Freedoms of 1950, Articles 1, 3, 7, 10 of the UN Declaration on the Rights of Indigenous Peoples of 2007; Art. 3, 6, 9 of the Universal Declaration of Human Rights of 1948.
Also in the case of the repeated deportation of Khalilov N.A. from Crimea as a Crimean Tatar by the Russian authorities the signs of continuing crime of genocide against the Crimean Tatar people can be seen in the form of its forced deportation, which began in 1944, that is a violation of the Convention on the Prevention of the Crime of Genocide and Punishment for it of 1948.
The human rights organization "The Crimean Tatar Resource Center" demands the Government of the Russian Federation to free Khalilov Nedim Abdulaevich from the detention places, to ensure the rights of Khalilov N.A. guaranteed by the above mentioned acts to life, medical health care, legal personality, freedom, and so forth, to compensate him inflicted illegal and unjust damage, caused by the actions of the authorities of the Russian Federation .
The human rights organization "The Crimean Tatar Resource Center" requires from the authorities of Ukraine: to ensure through diplomatic measures and international legal measures compliance by the Russian authorities of the above mentioned rules of the international law relating to Khalilov Nedim Abdulaevich.
The human rights organization "The Crimean Tatar Resource Center" urges the UN and its structures and institutions, UN bodies, monitoring universal treaties on Human Rights, the OSCE and its competent structures and institutions, the Council of Europe, its competent structures and institutions, governments of civilized countries, international human rights organizations ascertain the violations of the Russian Federation of the above mentioned rules of the international law and to ensure their further compliance by the Russian authorities concerning Khalilov Nedim Abdulaevich.
