The Crimean Tatar Resource Center submitted an analytical report to the UN Human Rights Committee as part of the preparation of General Comment No. 38 on Article 22 of the International Covenant on Civil and Political Rights, which guarantees the right to freedom of association.<\/p>\n

In its report, the CTRC emphasizes that freedom of association is of particular importance to indigenous peoples, as it is a key mechanism for preserving identity, representation, and self-government. After the occupation of Crimea by the Russian Federation in 2014, the inhabitants of the peninsula, primarily Crimean Tatars and ethnic Ukrainians, have been subjected to systematic pressure and persecution for their civic stance.<\/p>\n

The document pays particular attention to the Russian Federation’s ban on the Mejlis of the Crimean Tatar people, which was introduced in 2016 and has not yet been lifted, despite the decision of the UN International Court of Justice.<\/p>\n

\u201cThe ban on the Mejlis of the Crimean Tatar people was not directed against specific illegal actions; in fact, it was a reaction to the position of the representative body and the entire people regarding the rejection of the Russian occupation,\u201d the experts explained.<\/p><\/div>\n

\nThe CTRC recalled in the document that at the political level in Ukraine, the status of Mejlis as the representative body of the indigenous Crimean Tatar people was recognized by the Resolution of the Verkhovna Rada of Ukraine dated March 20, 2014. In 2021, the Law of Ukraine \u201cOn the Indigenous Peoples of Ukraine\u201d was adopted, in accordance with which the Resolution of the Cabinet of Ministers of Ukraine \u201cOn Approval of the Procedure for Establishing the Legal Status of the Representative Body of the Indigenous People of Ukraine and Deprivation of Such Status\u201d was adopted. In accordance with this, on June 14, 2023, the Mejlis of the Crimean Tatar People submitted an application with the necessary documents to the State Service of Ukraine for Ethnic Policy and Freedom of Conscience.<\/div>\n
“In accordance with the procedure, on October 6, 2023, the State Service of Ukraine for Ethnic Policy and Freedom of Conscience prepared and submitted to the Cabinet of Ministers of Ukraine a draft order of the Cabinet of Ministers of Ukraine on establishing the legal status of the representative body. This draft order has passed all the necessary approvals, but the Cabinet of Ministers of Ukraine has not yet adopted the relevant decision,” – the text says.<\/p>\n

Experts emphasized that the delay in confirming the legal status of Mejlis creates legal uncertainty. Although consultations with the Mejlis are in fact being held, they do not have the proper procedural form and legal force, which makes it impossible to fully take into account the position of the representative body of the indigenous people when making state decisions.<\/p>\n

The report also analyzes the practice of recognizing organizations as \u201cundesirable,\u201d which effectively leads to a complete ban on their activities and the revocation of their right to freedom of association, as well as the persecution of lawyers, activists, and representatives of civil society in occupied Crimea.<\/p>\n

\u201cToday, the register of \u2018undesirable organizations\u2019 in Russia includes about 200 international and Ukrainian organizations, among which is the Crimean Tatar Resource Center, which was added to the register in January 2024,\u201d – the experts added.<\/p>\n

Commenting on the submission of this report to the Crimean Information Agency (QHA), CTRC lawyer Liudmyla Korotkikh noted:<\/p><\/div>\n

Freedom of association is one of the most fundamental rights, especially under occupation, as it is directly linked to other rights, including the right to protection from discrimination. The importance of recording and documenting such violations and submitting relevant reports to international bodies cannot be denied. In addition to providing information, this report will serve as a source for the development of international standards. We hope that the UN Human Rights Committee, in its general comments, will not only take a firm stance on the protection of freedom of association under occupation, but will also provide recommendations on the protection and implementation of the right to association, especially in such circumstances.”<\/p>\n
