Eskender Bariiev, Chairman of the Board of the Crimean Tatar Resource Center and member of Mejlis of the Crimean Tatar People, took part in a meeting of the Expert Council on National Minorities and Indigenous Peoples under the Representative of the Commissioner for Equal Rights and Freedoms, Rights of National Minorities, political and religious views, dedicated to summarizing the results of activities for 2025 and discussing work plans for 2026.<\/p>\n

During the meeting:<\/p>\n

the activities of the Ukrainian Parliament Commissioner for Human Rights in the area of observance of the rights of national minorities (communities) and indigenous peoples of Ukraine for 2025 were presented;
\nthe work plan and proposals for the plan for 2026 were discussed;
\npriority areas for further cooperation, interaction, joint tasks, and initiatives for 2026 were identified;
\nthe results of the expert council’s work were summarized.
\nA presentation on the activities of the Ukrainian Parliament Commissioner for Human Rights was given by Oleksandr Osipov, Representative of the Commissioner for Equal Rights and Freedoms, Rights of National Minorities, Political and Religious Views, and Co-Chair of the Expert Council. He reported on the events that took place during 2025 with the participation or support of the Ukrainian Parliament Commissioner for Human Rights, in particular those initiated by national communities and dedicated to important national holidays or tragic dates, and outlined the key problems and ways to solve them.<\/p>\n

During the discussion of the work plan and proposals for the 2026 plan, Eskender Bariiev emphasized the following:<\/p><\/div>\n

1. Implementation of the Law of Ukraine \u201cOn Indigenous Peoples of Ukraine\u201d
\nThe Chairman of the Board of the CTRC emphasized the necessity of including a systematic process for implementing the Law of Ukraine \u201cOn Indigenous Peoples of Ukraine\u201d in the work plan of the Ukrainian Parliament Commissioner for Human Rights. He stressed that the law provides for the adoption of subordinate legislation within six months of its adoption, but in 2026 it will be five years since the law was adopted, while only two of the approximately 17 necessary subordinate acts have been adopted.<\/p>\n

2. Consolidating the legal status of Mejlis of the Crimean Tatar People
\nBariiev emphasized the necessity of completing the process of official recognition of the legal status of Mejlis of the Crimean Tatar People as the representative body of the indigenous Crimean Tatar people at the level of the Cabinet of Ministers of Ukraine. He recalled that in 2023, the relevant documents were submitted, agreed upon with the competent central executive authorities, and in October 2023, a draft order of the Cabinet of Ministers of Ukraine was prepared, which has not yet been signed, which is a violation of Ukrainian law.<\/p><\/div>\n

He also noted that the UN Committee on the Elimination of Racial Discrimination had made comments requiring the Cabinet of Ministers of Ukraine to resolve this issue. At the same time, in the decisions of the European Court of Human Rights in the case of \u201cThe Mejlis of the Crimean Tatar People v. the Russian Federation,\u201d the Mejlis is defined as the representative body of the indigenous people, and the Cabinet of Ministers of Ukraine is involved in the case as a third party.<\/p>\n

3. Assistance to released political prisoners in Crimea
\nHe separately raised the issue of the necessity of including in the work plans measures to provide assistance to Ukrainian citizens, in particular political prisoners who are released after protracted illegal imprisonment and face problems with restoring their Ukrainian documents, which makes it impossible for them to return to Ukraine.<\/p><\/div>\n

4. Risk of deportation after the release of political prisoners in Crimea
\nThe Chairman of the Board of the Crimean Human Rights Center drew attention to the practice of the Russian Federation, which forcibly naturalized (illegally imposed citizenship) people in the temporarily occupied territories, tried them as citizens of the Russian Federation, and is now depriving them of this citizenship for further deportation.<\/p>\n

As a result, after their release, many people, particularly from the Crimean Tatar community, may be deported to their places of birth in Central Asian countries and deprived of the opportunity to return to Crimea. In this regard, he stressed the necessity of finding a mediating country that could facilitate the return of such persons to Ukraine.<\/p>\n

5. Participation of indigenous peoples and national minorities in exchanges
\nHe also stressed the importance of ensuring that the presence of persons belonging to indigenous peoples and national minorities is taken into account during the exchange of prisoners of war and political prisoners.<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"
