Friends, very often we come across comments under our posts about the status of Crimea in future in independent Ukraine. Many say that the current status of the Autonomous Republic of Crimea needs to be changed, some talk about creating a region, and others say that autonomy is very important. Let’s try to find it out!<\/p>\n
So, what\u2019s wrong with the current status of the Autonomous Republic of Crimea and the city of Sevastopol? Indeed, there cannot be autonomy on an administrative-territorial basis in a unitary state. However, we cannot talk about the Crimean region.<\/p>\n
Many people think that the region status will become a fuse for separatism in Ukraine. But the Luhansk and Donetsk regions\u00a0 <\/span>did not become these fuses, which means that the problem is entirely in something different\u2026<\/p>\n The team of the Crimean Tatar Resource Center clearly emphasizes the importance of creating national-territorial autonomy as a form of self-determination for the indigenous peoples of Ukraine.<\/p>\n In fact, national-territorial autonomy is a legal mechanism for protecting the integrity of Ukraine. Why is this so?<\/p>\n After the deoccupation of Crimea, military administrations will first be created on the peninsula, and then military-civil administrations. During their operation, which may be 10 years, it will not be possible to hold elections, but do you believe that in at least 10 years the consciousness of the population of Crimea will change and they will be able to make the right choice?<\/p>\n This is where the national-territorial autonomy of Crimea will be helpful here. It is this autonomy which is the guarantor of preventing separatist sentiments on the peninsula. This type of autonomy is quite common in unitary states and is an effective tool for decentralizing power for a region distinguished by its ethnic specificity.<\/p>\n National-territorial autonomy provides for the presence of quotas in representative bodies of all levels, that is, in the Verkhovna Rada of Ukraine, the Verkhovna Rada of the Autonomous Republic of Crimea and local councils, mandates will be guaranteed for representatives of the indigenous Crimean Tatar people, of course, that quotas can be different and they are established by the relevant law. However, such a guaranteed representation of indigenous peoples in decision-making bodies, among other things, can prevent the adoption of decisions that are contrary to the interests and preservation of the integrity of Ukraine, because we all remember that the Crimean Tatars were and remain the core of resistance to the occupation of Crimea.<\/p>\n Another important aspect is the implementation of the principle of free, prior and informed consent with the representative body of the indigenous people in the event of decisions affecting them. For example, if this principle had been observed in 2010, when the agreement on the deployment of the Russian Black Sea Fleet in Sevastopol was extended, and the corresponding consultation had been held with the Mejlis of the Crimean Tatar people, most likely, the Russian fleet would not have been legally in Crimea in 2014, which would make it much more difficult for the Russians to capture the peninsula. Therefore, we should learn the lessons of the past in order to avoid making the same mistakes in the future.<\/p>\n What kind of future do we see in this area?<\/p>\n 1.Amendments have been made to Section X of the Constitution of Ukraine: the Autonomous Republic of Crimea within the Crimean peninsula – national-territorial autonomy – is a form of realization of the right of the Crimean Tatar people to internal self-determination and a guarantee of the protection of the rights of other indigenous peoples and national minorities of Ukraine in Crimea;<\/p>\n 2.The Autonomous Republic of Crimea has the Constitution of the Autonomous Republic of Crimea, which is adopted by the Verkhovna Rada of the Autonomous Republic of Crimea, approved by the Qurultay of the Crimean Tatar people and approved by the Verkhovna Rada of Ukraine;<\/p>\n 3.Acts of the authorities of the Autonomous Republic of Crimea on the implementation and protection of the rights of indigenous peoples are adopted on the basis of the free, prior and informed consent of indigenous peoples;<\/p>\n 4.Acts of the authorities of the Autonomous Republic of Crimea and representative bodies of the indigenous Crimean Tatar people cannot contradict international law, the Constitution and the laws of Ukraine;<\/p>\n 5.The representative body of the Autonomous Republic of Crimea is the Verkhovna Rada of the Autonomous Republic of Crimea, whose deputies are elected on the basis of universal, equal, direct suffrage by secret ballot. The guaranteed representation of the indigenous peoples of Ukraine in the Verkhovna Rada of the Autonomous Republic of Crimea is at least 1\/3 of its composition and has the right to veto decisions that violate the norms of the Constitution of Ukraine and the rights of indigenous peoples;<\/p>\n 6.The Verkhovna Rada of the Autonomous Republic of Crimea, within the limits of its powers, makes decisions and resolutions that are binding in the Autonomous Republic of Crimea;<\/p>\n 7.The government of the Autonomous Republic of Crimea is the Council of Ministers of the Autonomous Republic of Crimea. The Chairman of the Council of Ministers of the Autonomous Republic of Crimea is appointed and dismissed from office by the Verkhovna Rada of the Autonomous Republic of Crimea upon the proposal of the Mejlis of the Crimean Tatar people, agreed with the President of Ukraine;<\/p>\n 8.Justice in the Autonomous Republic of Crimea is administered by the courts of Ukraine;<\/p>\n 9.The President of Ukraine may stop the operation of acts of the Autonomous Republic of Crimea or acts of representative bodies of the Crimean Tatar people that do not comply with the Constitution of Ukraine and the laws of Ukraine, while simultaneously appealing to the Constitutional Court of Ukraine regarding their constitutionality or to the court regarding their legality;<\/p>\n 10. The representation of indigenous peoples of Ukraine in elected bodies of local self-government should be proportional to the demographic indicators of the relative number of indigenous peoples of Ukraine in the territory within which the relevant body operates.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":" Friends, very often we come across comments under our posts about the status of Crimea in future in independent Ukraine.
