In accordance with Article 53 of the Geneva Convention for the Protection of Civilian Population, the occupying State is prohibited to resort to any destruction of movable or immovable property that is the individual or collective property of individuals or the state, or other public institutions or social or cooperative organizations. In addition, such actions by the occupation authorities can be interpreted as a violation of the provisions of Article 1 of Protocol 1 of the ECHR on the protection of property rights, namely, a violation of the right to respect for one's property.<\/p>\n
According to Article 8 of the UN Declaration on the Rights of Indigenous Peoples, states provide effective mechanisms of prevention and legal protection to prevent actions aimed at depriving indigenous peoples of their lands, territory or resources, as well as forced displacement of the population in any form, the purpose or result of which is a violation or undermining any right of indigenous peoples.<\/p>\n
It is obvious that the Russian authorities, by these actions, are trying to deprive the Crimean Tatars, as the indigenous people of Ukraine, of their land ownership rights in order to replace the Crimean Tatar population in Crimea with a more loyal pro-Russian one.<\/p>\n
According to Article 25 of the Declaration, indigenous peoples have the right to maintain and strengthen their special spiritual bond with their traditionally owned or otherwise occupied or used lands, territories, waters and coastal waters and other resources. Article 26 specifies that indigenous peoples have the right to lands, territories and resources that they traditionally owned, which they traditionally occupied or in one way or another used or received, as well as the right to own, use, develop or control lands, territories and resources that they possess, taking into account traditional possession or other traditional occupation or use, as well as those that they have acquired in another way. It is the responsibility of States to legally recognize and protect such lands, territories and resources, and such recognition is carried out with due respect for the customs, traditions and land tenure systems of the indigenous peoples concerned. According to article 27 of the Declaration, indigenous peoples have the right to participate in the process of fair, independent, impartial, open and transparent process of recognition and legal confirmation of their rights to their own lands, territories and resources, taking into account those which they traditionally owned or which they otherwise occupied. or used. The obligation to reimburse the losses caused by the state to indigenous peoples is imposed on the state in accordance with the provisions of Article 28 of the Declaration.<\/p>\n
It is obvious that the authorities of the Russian Federation grossly violate the rights of the indigenous Crimean Tatar people, since de facto and de jure, without any agreement with the representative bodies of the Crimean Tatars, a regulatory act was adopted that could potentially deprive many Crimean Tatars of the ownership of land, who did not succumb to the pressure of the occupier and refused to accept Russian citizenship, remaining loyal to Ukraine.<\/p>\n
Also, this decree openly violates the rights of all citizens of Ukraine living in Crimea and having land ownership in the aforementioned territories. In particular, Article 13 of the Constitution of Ukraine proclaims that the land, its subsoil and other natural resources located within the territory of Ukraine are objects of property rights of the Ukrainian people. Every citizen has the right to use natural objects of the people's property right in accordance with the law. Article 14 of the Constitution of Ukraine guarantees the ownership of land. This right is acquired and exercised by citizens, legal entities and the state exclusively in accordance with the law. By the decree of the President of the Russian Federation, all of the above constitutional rights of Ukrainian citizens were not only grossly violated, but also de facto canceled.<\/p>\n
The Crimean Tatar Resource Center expresses its strong protest and declares that this decision of the President of the Russian Federation is illegal and criminal.<\/p>\n
The Crimean Tatar Resource Center believes that in this case the right of citizens of Ukraine to land ownership and use of natural resources, which are guaranteed by Articles 13 and 14 of the Constitution of Ukraine, was violated.<\/p>\n
Also, this decree violated the inalienable rights of the Crimean Tatar people as the indigenous people of Ukraine, contained in the UN Declaration on the Rights of Indigenous Peoples, paragraphs 4 and 5 of the Declaration on the National Sovereignty of the Crimean Tatar people, adopted by the II Qurultay of the Crimean Tatar people of June 28, 1991 and paragraph 4 Statements of the Mejlis of the Crimean Tatar people On the observance of the inalienable rights of the indigenous Crimean Tatar people during the temporary occupation of Crimea by the Russian Federation dated November 17, 2019, in particular, the right of the indigenous people to their own lands and the use of natural resources of such lands. The Russian authorities have also blatantly ignored the obligation imposed by the Declaration to coordinate land use and property rights to land within the boundaries of the traditional residence of indigenous peoples.<\/p>\n
The Russian Federation illegally uses its legislation for political purposes, in particular, with the aim of replacing the population of the occupied Crimea with a more loyal and pro-Russian one and persecuting the Crimean Tatars as the indigenous people of Ukraine and Crimea.<\/p>\n
