The lawyer explained that according to the Code of Criminal Procedure, it was established that after the indictment was approved, the prosecutor sends the case to court, which informs the accused, his defense counsel, the victim, civil plaintiff, civil defendant and (or) representatives and explains to them the right to file a motion to initiate a preliminary hearing.<\/p>\n

“As we see, the investigator, the head of the investigating authority, the investigating authority itself is not specified in the law as the addressee of the notification of the prosecutor about the case being sent to court. But in the occupied Crimea it’s the other way around. They didn’t notify me (the defense attorney), they didn’t notify Mustafa-a\u011fa, but the first in the case who was illegally notified was the investigating authority, which cheerfully reported it”,- the report said.<\/p>\n<\/blockquote>\n

Mustafa Dzhemilev is charged under Part 3 of Article 322 of the Criminal Code of Russia – “Illegal Crossing of the State Border of Russia”, under Part 1 of Article 222 – “Illegal acquisition, transfer, sale, storage, transportation or carrying of weapons, their main parts, ammunition” and under Article 224 – “Careless storage of firearms, creating conditions for its use by another person, if this entailed the death of a person or other serious consequences.”<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
